{"id":52073,"date":"2021-10-25T15:53:50","date_gmt":"2021-10-25T13:53:50","guid":{"rendered":"https:\/\/www.krik.rs\/?p=52073"},"modified":"2024-04-15T11:22:16","modified_gmt":"2024-04-15T09:22:16","slug":"chinese-tech-giant-huawei-had-secret-offshore-contracts-with-men-linked-to-serbian-state-telecom-company","status":"publish","type":"post","link":"https:\/\/www.krik.rs\/en\/chinese-tech-giant-huawei-had-secret-offshore-contracts-with-men-linked-to-serbian-state-telecom-company\/","title":{"rendered":"Chinese Tech Giant Huawei Had Secret Offshore Contracts With Men Linked to Serbian State Telecom Company"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"><strong>Amid a Chinese push to gain influence in Serbia, Huawei appears to have paid large sums to a former Serbian state telecom executive through an offshore shell company.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><em>Authors: <\/em><\/strong> <strong><em>Stevan Doj\u010dinovi\u0107 (OCCRP\/KRIK) and Vesna Radojevi\u0107 (KRIK)<\/em><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Chinese tech giant Huawei signed deals to make large payments to two men close to Serbia\u2019s state telecommunications company, using offshore companies that financial crime experts say raise red flags for corruption.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">One of these men, former Telekom Srbija executive Igor Jecl, appears to have received over $1.4 million in contracts, dividends, loans, consulting fees, and an apartment from an offshore company that was paid by Huawei for consultancy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Neither offshore company that dealt with Huawei has a public track record of doing consulting work, or any business at all.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cIt is standard with bribery and corruption to dress them up as consultancy,\u201d said Graham Barrow, an expert on financial crime.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Although OCCRP has not uncovered evidence that the payments were improper, they were made over a period of time when Huawei was doing business in Serbia. In 2016, it landed a 150-million-euro deal to upgrade Serbia\u2019s telecommunications infrastructure.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reporters found out about the deals through The Pandora Papers, a leak of nearly 12 million documents from 14 offshore service providers obtained by the International Consortium of Investigative Journalists and shared with news organizations including KRIK and OCCRP. They provide an inside look at how the wealthy and powerful hide money in secretive jurisdictions like Panama and the British Virgin Islands.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The papers suggest that Jecl wasn\u2019t just dealing with Huawei on his own, but tapping into an existing offshore structure set up by another person: Milorad Ignja\u010devi\u0107, a prominent Serbian lawyer who had business ties to Telekom.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"alignright size-full is-resized\"><a href=\"https:\/\/www.krik.rs\/wp-content\/uploads\/2024\/04\/Jecl-003.jpg\"><img fetchpriority=\"high\" decoding=\"async\" width=\"800\" height=\"930\" src=\"https:\/\/www.krik.rs\/wp-content\/uploads\/2024\/04\/Jecl-003.jpg\" alt=\"\" class=\"wp-image-52074\" style=\"width:228px;height:auto\" srcset=\"https:\/\/www.krik.rs\/wp-content\/uploads\/2024\/04\/Jecl-003.jpg 800w, https:\/\/www.krik.rs\/wp-content\/uploads\/2024\/04\/Jecl-003-258x300.jpg 258w, https:\/\/www.krik.rs\/wp-content\/uploads\/2024\/04\/Jecl-003-768x893.jpg 768w, https:\/\/www.krik.rs\/wp-content\/uploads\/2024\/04\/Jecl-003-126x146.jpg 126w, https:\/\/www.krik.rs\/wp-content\/uploads\/2024\/04\/Jecl-003-43x50.jpg 43w, https:\/\/www.krik.rs\/wp-content\/uploads\/2024\/04\/Jecl-003-65x75.jpg 65w\" sizes=\"(max-width: 800px) 100vw, 800px\" \/><\/a><figcaption class=\"wp-element-caption\">One of the invoices sent from Jecl\u2019s offshore company to Huawei, for 150,000 euros.<\/figcaption><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">Pandora Papers documents only provide a brief snapshot of how Jecl\u2019s and Ignacevic\u2019s companies operated, but among them are multiple invoices showing planned payments to the offshores, justified by contracts with Huawei.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Together, the two companies had at least six such contracts, for which they issued invoices to collect at least 947,399 euros (about $1.1 million). Four of the contracts were handed over from one of their shell companies, in Panama, to another one in the British Virgin Islands, for reasons that were not explained.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Pandora Papers include the full details of only one of these contracts. Signed on January 1, 2014, it stipulates that the consultant would be paid 359,000 euros (over $493,000) to organize meetings for Huawei with Serbian telecom officials and executives.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The consultant is also asked to help Huawei obtain approvals and licenses, and \u201curge the Customer [Telekom] to make the payment to Huawei timely and promptly.\u201d Another document in the Pandora Papers shows that the contract was fulfilled, and the 359,000 euros were paid.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The new revelations about the Serbian deals come amid widespread distrust of Huawei, which is pitching its 5G networks around the globe. Australia, the U.S. and the U.K. have all banned Huawei from building 5G infrastructure for fear that China could use it for spying. U.S. officials have pointed to the military background of Huawei\u2019s founder, Ren Zhengfei, while the company has stated that it \u201cwould categorically refuse to comply\u201d with any orders to spy.<\/p>\n\n\n\n<div class=\"antrfile\" id=\"antrfile\" style=\"padding:20px; margin-left: 10px; margin-top: 10px; margin-bottom: 10px; float: right; background-color: #d3d3d3; width: 50%; font-size: 80%;\">\n<strong>\nThe Limitations of the Data\n<\/strong><br>\n<br>\nBecause the documents in The Pandora Papers are just a snapshot of the activities of offshore law firms and service providers such as Aleman, Cordero, Galindo &#038; Lee (Alcogal), the Panamanian law firm whose British Virgin Islands branch was used to set up Rofly Investments, it is possible that there were more contracts or payments not captured in the leak. Alcogal did not respond to questions from journalists on its role in setting up Rofly, or whether it knew the beneficial owner of the company that owned Rofly.\n<br>\n<br>\nThe documents, which include contracts, invoices, and company registration papers, were not signed in every case since they were leaked from the service provider in electronic form. OCCRP and KRIK did not have access to payment and transaction details, but the evidence examined by journalists strongly suggests the contracts and invoices were executed \u2014 including documents confirming that over 650,000 euros\u2019 worth of contracts were completed and the money was paid by Huawei.\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Amid a Chinese push to extend its political influence into the Balkans, Telekom Srbija \u2014 where Jecl was a department head from 2005 to 2008 \u2014 began purchasing equipment from Huawei in 2006. A decade later, the two companies signed a 150-million-euro deal to overhaul Serbia\u2019s communications network under terms that remain opaque.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Vladimir Lucic, the current CEO of Telekom, said he had been completely in the dark about the consulting arrangement, and was not aware of any consulting having been done. The ownership of the companies is odd. Why not use a Serbian company? \u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jecl, now 56, joined Telekom in 2005 after spending two years as an adviser to the company\u2019s former CEO, Drasko Petrovi\u0107, who has ties to the Democratic Party of Serbia. He was seen as an innovator at the state company, where he was involved in major projects to bring broadband internet and internet radio to Serbia. But he resigned in 2008 and disappeared from the public eye.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI haven\u2019t had any contact with him since he left Telekom,\u201d said Lucic, the former CEO.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now, his name has resurfaced in the Pandora Papers \u2014 among documents leaked from a law firm in the British Virgin Islands, where he became the owner of a shell company called Rofly Investments Ltd. in December 2015.<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><a href=\"https:\/\/www.krik.rs\/wp-content\/uploads\/2021\/10\/KRIK-Rofly.png\"><img decoding=\"async\" width=\"1024\" height=\"672\" src=\"https:\/\/www.krik.rs\/wp-content\/uploads\/2021\/10\/KRIK-Rofly-1024x672.png\" alt=\"\" class=\"wp-image-40142\" srcset=\"https:\/\/www.krik.rs\/wp-content\/uploads\/2021\/10\/KRIK-Rofly-1024x672.png 1024w, https:\/\/www.krik.rs\/wp-content\/uploads\/2021\/10\/KRIK-Rofly-300x197.png 300w, https:\/\/www.krik.rs\/wp-content\/uploads\/2021\/10\/KRIK-Rofly-768x504.png 768w, https:\/\/www.krik.rs\/wp-content\/uploads\/2021\/10\/KRIK-Rofly-223x146.png 223w, https:\/\/www.krik.rs\/wp-content\/uploads\/2021\/10\/KRIK-Rofly-50x33.png 50w, https:\/\/www.krik.rs\/wp-content\/uploads\/2021\/10\/KRIK-Rofly-576x378.png 576w, https:\/\/www.krik.rs\/wp-content\/uploads\/2021\/10\/KRIK-Rofly-114x75.png 114w, https:\/\/www.krik.rs\/wp-content\/uploads\/2021\/10\/KRIK-Rofly.png 1200w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/a><figcaption class=\"wp-element-caption\">Jecl became the owner of Rofly in December 2014.<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>A British Virgin Islands Mystery<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Rofly had been set up in 2011, but was originally owned by another shell company based in Panama, where corporate secrecy laws make it difficult to know who was behind it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This layered ownership structure is a common tactic to obscure the identities of the people behind a company, Delston said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe two companies in different offshore financial centers, one owning the other, is a form of layering of beneficial ownership to further ensure anonymity,\u201d he said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the years between when it was set up and when Jecl took over, Rofly had already received 650,000 euros (around $768,000) from Huawei. Credit:&nbsp;OCCRP\/KRIK<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Jecl, in turn, made agreements to receive large sums of money from Rofly even before he owned it, suggesting he had a pre-existing relationship with the company.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In early 2015, Rofly agreed to pay him 50,000 euros ($56,421) for consultancy. Later that year, the company said it would loan him 250,000 euros ($265,376) to set up a chain of ice cream shops in Spain, according to a draft agreement and business plan found in the Pandora Papers.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Just three days before Jecl took over Rofly, the company received four more consultancy contracts with Huawei in an unusual way \u2014 they were transferred directly to Rofly from a shell company in Panama belonging to Ignja\u010devi\u0107, the lawyer with ties to Telekom<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This meant that, seemingly out of nowhere, Jecl became the owner of a company that held at least five contracts to consult for Huawei.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The earliest of these was inked in 2007, two years after Huawei opened its first office in Belgrade, on the vanguard of a wave of Chinese investment that has poured into Serbia since then. In addition to its deal with Telekom, the Chinese firm is working with Serbian police to install nearly 1,000 high-tech facial-recognition cameras across Belgrade. This \u201cSafe Cities\u201d project has sparked concern in the EU over China\u2019s export of so-called \u201cdigital authoritarianism,\u201d and led to an outcry among privacy advocates and many ordinary Serbs who see it as dystopian and intrusive.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The company has also faced allegations of bribery in countries including Ghana, the Solomon Islands, and Algeria. Credit:&nbsp;KRIK<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Tracing a Panama Company Back to Serbia<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Goldberg Brokerage, the Panama-based company that handed the Huawei contracts to Rofly, was able to conceal its owner due to the Central American nation\u2019s corporate secrecy laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it did publicly report its officers. Journalists noticed that its director and treasurer was listed as Ignja\u010devi\u0107, the lawyer whose family firm has been a Belgrade fixture since 1945.<\/p>\n\n\n\n<div class=\"antrfile\" id=\"antrfile\" style=\"padding:20px; margin-left: 10px; margin-top: 10px; margin-bottom: 10px; float: right; background-color: #d3d3d3; width: 50%; font-size: 80%;\">\n<strong>\nIgnja\u010devi\u0107\u2019s Lucrative Links to Telekom\n<\/strong><br>\n<br>\nWhile Milorad Ignja\u010devi\u0107 says he was never employed by Telekom Serbia, his family was involved in a business venture with the state-owned company that appears to have netted them a significant windfall.\n<br>\n<br>\nThe family\u2019s association with Telekom began in 2005, when Ignja\u010devi\u0107\u2019s son, Uro\u0161, wanted to start a web portal that carried information on upcoming events. He said he pitched the concept to Telekom and managed to convince the state-owned giant to invest in Nadlanu, which translates to \u201cIn Your Palm.\u201d\n<br>\n<br>\nOver the next five and a half years, Telekom made monthly payments to Trident Media Group, a company majority-owned by Milorad and Uro\u0161 Ignja\u010devi\u0107, to develop and create content for Nadlanu.\n<br>\n<br>\nIt is not known how much money Telekom invested in Nadlanu, but it grew fast. By 2010, Nadlanu ranked in the top 15 websites in Serbia by traffic. Then, in 2011, Telekom abruptly divested, selling its entire stake in Nadlanu to Trident Media for just 1 Serbian dinar (about $.01).\n<br>\n<br>\nIt\u2019s unclear why Telekom would have done this. Nadlanu was still a very popular website at the time, and by 2014 an internal estimate valued the site at 555,000 euros, according to corporate records obtained by KRIK. Ignja\u010devi\u0107 says his company still owns the site, but licenses it to Color Press Group, one of Serbia\u2019s leading media companies, for a fee that neither company would divulge.\n<br>\n<br>\nCvjetin Milivojevic, a Serbian media expert, said Telekom\u2019s decision to put money into the portal and then abandon it did not seem to make business sense. \u201cYou [usually] leave a job when there is no more profit,\u201d he said.\n<br>\n<br>\n\u201cThis is more proof that money is being pushed into something by a political order.\u201d\n<br>\n<br>\nTelekom CEO Vladimir Lucic said Telekom left the venture because its contract with Trident was \u201cunfavorable,\u201d and the web portal wasn\u2019t helping Telekom\u2019s bottom line.\n<br>\n<br>\nExplaining how he had convinced a state-owned giant to invest large amounts of money in a small project by an unknown entrepreneur, Uro\u0161 Ignacevic said he had simply made a great pitch to a Telekom Serbia executivebent on innovation and supporting new ideas.\n<br>\n<br>\nHis name? Igor Jecl.\n<\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Ignja\u010devi\u0107 and his family also had business ties to Telekom, reporters have learned.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Now retired, the 84-year-old lawyer was courteous and forthcoming in an interview at his office in Belgrade\u2019s central Vra\u010dar neighborhood. Credit:&nbsp;Milorad Ignja\u010devi\u0107\/Instagram.<\/figcaption><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">\u201cIts purpose was to be a means for future businesses,\u201d the lawyer said. \u201cIt was founded with the hope that it would get some work in future.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, when reporters asked him about Goldberg Brokerage\u2019s contracts with Huawei, he said he suddenly remembered that Huawei had paid him through the offshore company for advisory work.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHuawei had been there [in Serbia] for two, three years, trying to get some business,\u201d Ignja\u010devi\u0107 said. \u201cThen, I helped by advising them.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">When he asked if he lobbied on behalf of Huawei in Telekom, he said: \u201cFor sure, I did. If anyone from Telekom asks what my opinion is about Huawei, I will for sure say, \u2018Take Huawei.\u2019\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He also presented himself and his son as \u201cgood friends\u201d of Jecl, and described the former Telekom director in glowing terms as \u201ca top expert, a man ahead of his time.\u201d But after being asked detailed questions about Jecl, Ignja\u010devi\u0107 backtracked and insisted they were no longer in touch.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">He said he was appalled to hear that Goldberg\u2019s contracts with Huawei had been transferred to his friend\u2019s offshore company.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThis is news to me and unfortunately shocking,\u201d he said. \u201cI had no idea that there was a company [called] Rofly, nor that a contract had been concluded under which Rofly would take over my Goldberg business. Credit:&nbsp;Facebook<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">Eccolo Gelato\u2019s stores, in Sotogrande and Madrid, garner rave reviews on TripAdvisor and Google for their affogatos and scoops in flavors like banana, cinnamon, and dulce de leche.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On its Facebook page, Eccolo boasts that it has been making gelato since 1912, using \u201crecipes developed more than 100 years ago by Schiavi family in Almenno San Bartolomeo, the picturesque Italian village near Bergamo.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But while the recipes may be ancient, the company is not. Repeated attempts to reach him for comment, both directly and through his business, were unsuccessful. He no longer appears to maintain an address in Serbia, and his British Virgin Islands company has been shut down.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, reporters did find traces of Jecl in another tropical destination.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Documents found in The Pandora Papers reveal that he owned yet another offshore company in the Bahamas, Topville Investment.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Topville doesn\u2019t appear to have conducted any business, but a few months after it was set up in 2014, it was given the purchase contract for a luxury condo under construction in a gated complex on the north coast of Nassau, the most populous island in the Bahamas. It\u2019s not clear how much of the contract was paid off, but a year later Jecl sold the condo for $490,000.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Again, the contract came from Rofly Investments, the mysterious offshore company that signed contracts to consult for Huawei.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Like Rofly, Topville is no longer active \u2014 it was dissolved in September 2017.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The only reason given for shuttering the company? \u201cIt has no further use.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Amid a Chinese push to gain influence in Serbia, Huawei appears to have paid large sums to a former Serbian state telecom executive through an offshore shell company.
